OIAD – Osservazione giudiziaria dell’udienza di Chawki Tabib a Tunisi
Pubblichiamo la comunicazione pervenutaci da OIAD – Observatoire international des avocats en danger – in merito alla Missione di osservazione giudiziaria del processo di Chawki Tabib che avrà luogo a Tunisi dal 17 al 19 maggio 2026:
“Chers membres de l’OIAD,
L’OIAD lance un appel à manifestation d’intérêt (AMI) pour la prochaine mission d’observation judiciaire qui aura lieu à Tunis, en Tunisie du 17 au 19 mai 2026.
Affaire concernée :
Me Chawki Tabib, ancien Bâtonnier de l’Ordre national des avocats de Tunisie et ancien président de l’Instance nationale de lutte contre la corruption (INLUCC), fait l’objet de poursuites judiciaires pour faux et usage de faux en lien avec ses activités durant la période où il dirigeait l’INLUCC.
Cette affaire s’inscrit dans un contexte de tensions politiques et institutionnelles autour de la lutte contre la corruption en Tunisie. Plusieurs procédures visant Me Tabib concernent des dossiers de corruption impliquant de hauts responsables publics. Par ailleurs, il a déjà fait l’objet de différentes mesures judiciaires et administratives, notamment une assignation à résidence et une interdiction de voyager.
L’ancien Bâtonnier a comparu devant la chambre criminelle de Tunis le 6 avril 2026. L’affaire a été renvoyée au 27 avril 2026, puis reportée au 18 mai 2026.
La mission se déroulera du 17 au 19 mai 2026 à Tunis.

Le budget :
Le budget dédié comprend les frais relatifs à la mission, à savoir, le transport aérien (classe économique), ainsi qu’un per diem de 125€ par nuit couvrant les frais de logement, transport interne et les repas.
Obligations de l’observateur :
Nous vous rappelons que parmi les engagements des observateurs, est compris la rédaction d’un rapport dans les 15 jours suivant la mission, qui sera publié sur le site de l’OIAD. En ce sens, nous vous prions de bien vouloir consulter le « chapitre 3 du règlement intérieur de l’OIAD » ci-joint.
Ce rapport final doit comprendre obligatoirement une synthèse et analyse juridique de l’audience (rappel du contexte dans lequel elle s’inscrit ; compte-rendu du déroulé de l’audience ; analyse critique du procès et de l’audience) à laquelle vous aurez assistée. Veuillez trouver un modèle de rapport ci-joint.

Dear members of the OIAD,
The OIAD is launching a call for expressions of interest (CEI) for the next judicial observation mission, which will take place in Tunis, Tunisia, from 17 to 19 May 2026.
Case in question:
Mr. Chawki Tabib, former President of the Tunisian National Bar Association and former President of the National Anti-Corruption Authority (INLUCC), is subject to judicial proceedings for forgery and use of forged documents in connection with his activities during the period in which he headed the INLUCC.
This case arises in a context of political and institutional tensions surrounding the fight against corruption in Tunisia. Several proceedings targeting Mr. Tabib concern corruption cases involving high-ranking public officials. In addition, he has already been subjected to various judicial and administrative measures, including house arrest and a travel ban.
The former President of the Bar appeared before the Criminal Chamber of Tunis on 6 April 2026. The case was adjourned to 27 April 2026 and subsequently postponed to 18 May 2026.
The mission will take place in Tunis from 17 to 19 May 2026.

Budget:
The dedicated budget covers the costs of the mission, namely air travel (economy class) and a per diem of €125 per night to cover accommodation, internal transport and meals.
Obligations of the observer:
We remind you that one of the commitments of observers is to write a report within 15 days of the mission, which will be published on the OIAD website. In this regard, please refer to “Chapter 3 of the OIAD Rules of Procedure” attached.
This final report must include a summary and legal analysis of the hearing (background information; report on the proceedings; critical analysis of the trial and the hearing) that you attended. Please find a report template attached.
