OIAD – Osservazione giudiziaria del processo di Ahmed Souab (Tunisia)
Pubblichiamo la comunicazione pervenutaci da OIAD – Observatoire international des avocats en danger – in merito alla Missione di osservazione giudiziaria del processo di Ahmed Souab che avrà luogo a Tunisi dal 22 al 24 febbraio 2026:
“Affaire concernée :
Me Ahmed Souab est un avocat et ancien magistrat, reconnu pour son intégrité et son attachement indéfectible aux principes de justice. Son parcours professionnel et sa réputation d’incorruptibilité lui ont valu un grand respect au sein de la profession et dans l’opinion publique.
Dans le cadre de l’affaire dite du « complot », Me Souab faisait partie du collectif d’avocats assurant la défense des personnes poursuivies. À l’issue d’une audience particulièrement sensible, il a publiquement déclaré que « les avocats n’étaient pas les seuls à avoir un couteau sous la gorge, mais que les magistrats étaient dans la même situation », exprimant une préoccupation partagée sur les pressions subies par les acteurs du système judiciaire.
Ces propos ont été interprétés par les autorités comme une atteinte à l’institution judiciaire. En conséquence, Me Souab a été arrêté, déféré devant le juge d’instruction, puis inculpé, ce qui a suscité une vive émotion au sein de la société civile, du barreau et de la population en général. Une demande de libération provisoire pour raison de santé avait été formulée et rejetée le 12 février 2026. L’audience a été renvoyée au 23 février 2026.
La mission se déroulera du 22 au 24 février à Tunis.

Le budget :
Le budget dédié comprend les frais relatifs à la mission, à savoir, le transport aérien (classe économique), ainsi qu’un per diem de 125€ par nuit couvrant les frais de logement, transport interne et les repas.
Obligations de l’observateur :
Nous vous rappelons que parmi les engagements des observateurs, est compris la rédaction d’un rapport dans les 15 jours suivant la mission, qui sera publié sur le site de l’OIAD. En ce sens, nous vous prions de bien vouloir consulter le « chapitre 3 du règlement intérieur de l’OIAD ».
Ce rapport final doit comprendre obligatoirement une synthèse et analyse juridique de l’audience (rappel du contexte dans lequel elle s’inscrit ; compte-rendu du déroulé de l’audience ; analyse critique du procès et de l’audience) à laquelle vous aurez assistée. Veuillez trouver un modèle de rapport ci-joint.

The OIAD is launching a call for expressions of interest (CEI) for the next judicial observation mission, which will take place in Tunis, Tunisia, from 22 to 24 February 2026.
Case in question:
Mr Ahmed Souab is a solicitor and former magistrate, renowned for his integrity and unwavering commitment to the principles of justice. His professional career and reputation for incorruptibility have earned him great respect within the profession and among the general public.
In the so-called “conspiracy” case, Mr Souab was part of the team of lawyers defending the accused. At the end of a particularly sensitive hearing, he publicly stated that ‘lawyers were not the Only ones with a knife to their throats, but that magistrates were in the same situation,’ expressing a shared concern about the pressure exerted on those involved in the judicial system.
These remarks were interpreted by the authorities as an attack on the judicial institution. As a result, Mr Souab was arrested, brought before the investigating judge and then charged, which caused a stir among civil society, the bar and the general public. A request for provisional release on health grounds had been made and rejected on 12 February 2026. The hearing was adjourned until 23 February 2026.
The mission will take place from 22 to 24 February 2026 in Tunis.

Budget:
The dedicated budget covers the costs of the mission, namely air travel (economy class) and a per diem of €125 per night to cover accommodation, internal transport and meals.
Obligations of the observer:
We remind you that one of the commitments of observers is to write a report within 15 days of the mission, which will be published on the OIAD website. In this regard, please refer to “Chapter 3 of the OIAD Rules of Procedure” attached.
This final report must include a summary and legal analysis of the hearing (background information; report on the proceedings; critical analysis of the trial and the hearing) that you attended. Please find a report template attached.
