OIAD – Osservazione giudiziaria di Sonia Dahmani
Pubblichiamo la comunicazione pervenutaci da OIAD – Observatoire international des avocats en danger – in merito alla Missione di osservazione giudiziaria del processo di Sonia Dahmani che avrà luogo a Tunisi dal 2 al 4 aprile 2026:
“Chers membres de l’OIAD,
L’OIAD lance un appel à manifestation d’intérêt (AMI) pour la prochaine mission d’observation judiciaire qui aura lieu à Tunis, en Tunisie du 2 au 4 avril 2026.
Affaire concernée :
Me Sonia Dahmani, avocate et chroniqueuse tunisienne, fait l’objet de multiples poursuites judiciaires en lien avec ses prises de parole publiques sur la situation des droits humains et les discriminations en Tunisie.
La mission d’observation portera sur l’audience en appel dans l’affaire correctionnelle dite «Racisme II», engagée sur le fondement du décret-loi n° 2022-54. Dans le cadre de cette procédure, Me Sonia Dahmani est poursuivie pour des déclarations dans lesquelles elle dénonçait la persistance de certaines pratiques et comportements racistes dans la société tunisienne.
Le 30 juin 2025, Me Dahmani a été condamnée à deux années d’emprisonnement dans cette affaire et a interjeté appel. Dans le cadre de la procédure d’appel, plusieurs audiences ont déjà eu lieu, notamment les 21, 28 novembre 2025 et le 16 janvier 2026.
La mission se déroulera du 2 au 4 avril 2026 à Tunis.

Le budget :
Le budget dédié comprend les frais relatifs à la mission, à savoir, le transport aérien (classe économique), ainsi qu’un per diem de 125€ par nuit couvrant les frais de logement, transport interne et les repas.
Obligations de l’observateur :
Nous vous rappelons que parmi les engagements des observateurs, est compris la rédaction d’un rapport dans les 15 jours suivant la mission, qui sera publié sur le site de l’OIAD. En ce sens, nous vous prions de bien vouloir consulter le « chapitre 3 du règlement intérieur de l’OIAD » ci-joint.
Ce rapport final doit comprendre obligatoirement une synthèse et analyse juridique de l’audience (rappel du contexte dans lequel elle s’inscrit ; compte-rendu du déroulé de l’audience ; analyse critique du procès et de l’audience) à laquelle vous aurez assistée. Veuillez trouver un modèle de rapport ci-joint.

Dear OIAD members,
The OIAD is launching a call for expressions of interest (CEI) for the next judicial observation mission, which will take place in Tunis, Tunisia, from 2 to 4 April 2026.
Case in question:
Sonia Dahmani, a Tunisian lawyer and columnist, is facing multiple legal proceedings related to her public statements on the human rights situation and discrimination in Tunisia.
The observation mission will concern the appeal hearing in the criminal case known as «Racisme II», initiated on the basis of Decree-Law No. 2022-54. Within the framework of this procedure, Ms. Sonia Dahmani is being prosecuted for statements in which she denounced the persistence of certain racist practices and behaviours in Tunisian society.
On 30 June 2025, Ms. Dahmani was sentenced to two years of imprisonment in this case and lodged an appeal. Within the framework of the appeal procedure, several hearings have already taken place, notably on 21 and 28 November 2025 and on 16 January 2026.
The mission will take place from 2 to 4 April 2026 in Tunis.

Budget:
The dedicated budget covers the costs of the mission, namely air travel (economy class) and a per diem of €125 per night to cover accommodation, internal transport and meals.
Obligations of the observer:
We remind you that one of the commitments of observers is to write a report within 15 days of the mission, which will be published on the OIAD website. In this regard, please refer to “Chapter 3 of the OIAD Rules of Procedure” attached.
This final report must include a summary and legal analysis of the hearing (background information; report on the proceedings; critical analysis of the trial and the hearing) that you attended. Please find a report template attached.
